PRIVACY POLICY PURSUANT TO ART. 13 OF REGULATION U.E. 2016/679

The Customer is informed and accepts that his/her personal data may be collected on the site and used by TYR EUROPE SAS, which acts as data controller within the meaning of the French Data Protection Act 78-17 of January 6, 1978 as amended on January 20, 2017 and as modified by the General Data Protection Regulation 2016/679 dated April 27, 2016 (hereinafter the "Data Protection Act").

TYR EUROPE SAS undertakes to protect and ensure the security and confidentiality of its customers' personal data, in accordance with the French Data Protection Act (Loi Informatique et Libertés), in particular by taking all necessary precautions to prevent such data from being stolen, distorted, damaged or accessed by unauthorized third parties. In the event of a personal data breach, TYR EUROPE SAS will notify the CNIL as soon as possible after the breach has been discovered. If the personal data breach is likely to result in a high risk to the rights and freedoms of a Customer, TYR EUROPE SAS shall inform the person concerned of the personal data breach as soon as possible.
Customers' personal data may be passed on to service providers and contractual partners who, as subcontractors within the meaning of the French Data Protection Act (Loi Informatique et Libertés), intervene and contribute directly to the management of orders and for whom it is absolutely necessary to have access to the personal data provided by the Customer when creating and using his/her account (identity, postal address, telephone number, e-mail address). Subcontractors may only act on the instructions of TYR EUROPE SAS.
Customers' personal data may also be transmitted to external service providers for certain processing purposes, such as the analysis of customer reviews, in-store reservations, etc. (see list of collection purposes below). In such cases, the data is transmitted anonymously (i.e. addresses and identity details are not included), or if this is not the case, the service provider has undertaken not to use it for its own purposes or to communicate it to a third party. These entities are also obliged, to the same extent as TYR EUROPE SAS, to ensure the protection of personal data. Subcontractors may only act on the instructions of TYR EUROPE SAS. Your data may be transferred outside the European Union to our contractual service providers for the performance of our contractual obligations, as well as to our commercial partners. In such cases, we will inform you and ensure that your data is adequately protected in accordance with French and European regulations. Subcontractors may only act on the instructions of TYR EUROPE SAS.
Finally, legislation or legal proceedings may also oblige us to disclose your personal data.
Customer personal data is collected for the following purposes:

- Managing orders and customer relations.
- Informing customers of offers and commercial information relating to the brand.
- Reinforcing and improving the communication of the Internet site and the brand by sending, in particular, newsletters and special offers according to the Customer's preferences noted on the site.
- To improve and personalize the services offered to customers.
- Carrying out statistical studies and analyzing the purchasing habits of TYR EUROPE SAS customers.
- Targeted advertising (see Cookie Policy).
- Participation in competitions.
- Management of the TYR EUROPE SAS loyalty program.
- Management of customer reviews of our products.
- Geolocation to help find stores near the customer's location, provided the customer shares his or her location and complies with legal and regulatory obligations.

Under no circumstances does TYR EUROPE SAS receive, record or retain any information whatsoever concerning your banking details. Your personal data is kept for three years from the end of the commercial relationship or the last contact. However, data may be kept and archived for a longer period to comply with a legal obligation.
In accordance with the French Data Protection Act, customers have the right to access, rectify and object to personal data concerning them, as well as the right to lodge a complaint with a supervisory authority, the right to limit processing, the right to erase data and the right to data portability (hereinafter referred to as "Data Protection Rights").
However, this data portability is limited to data voluntarily transmitted by the customer, for example by filling in a form, or data generated as a result of the customer's activity, such as purchase history or connection data recorded when browsing the merchant site.
Personal data derived, calculated or inferred from data supplied by the data subject, such as a user profile created by analyzing the raw data produced by a "smart" meter, are excluded from the right to portability, insofar as they are not supplied by the data subject, but created by the organization.
To exercise one or more of these rights, the customer must send a request by e-mail or by post to the TYR EUROPE SAS customer service department, by filling in the contact form on the site or by writing to the following address, giving the customer's surname, first name, e-mail address and customer references: TYR EUROPE SAS - Service client - 26 Quai de l'Alma 68100 MULHOUSE , or by e-mail to accueil-fr@tyr.com. You may also contact us to give us instructions on what you wish to happen to your data after your death.
Each request must be signed and accompanied by a photocopy of an identity document bearing the customer's signature, and must specify the reply address.
A reply to a request made on the basis of one or more of the Data Protection rights will be sent within one month of receipt of the request.
Finally, you may lodge a complaint with a supervisory authority. The present charter may be modified at any time. We invite you to consult it regularly to be kept informed of any changes.
